Article 1. Definitions
1.1 Breakout Bandits: Breakout Bandits, a sole proprietorship established in Berkel en Rodenrijs, at Leeweg 32, registered with the Chamber of Commerce under number 84049863.
1.2 Client: the company or natural person who has purchased a Game from Breakout Bandits.
1.3 Player: the natural person who wishes to participate in a Game through the Client.
1.4 Personalized Games: the following games offered by Breakout Bandits: Capture The Flag, Capture The Flag XL – The Roadtrip Edition, and Paparazzi On The Run, as described on the Breakout Bandits website.
1.5 Adventures: fully customized events tailored by Breakout Bandits for the Client, including but not limited to the ‘surprise road trips’ described on the Breakout Bandits website and [to be filled in as applicable].
1.6 Games: Personalized Games and Adventures collectively.
Article 2. Applicability
2.1 These general terms and conditions apply to every Player who wishes to play a Game.
2.2 If one or more provisions of these general terms and conditions are found to be wholly or partially void or annulled at any time, the remaining provisions will remain fully applicable.
Article 3. Players
3.1 The Player is responsible for correctly and fully completing the Breakout Bandits questionnaire, if applicable.
3.2 The minimum age for participation in a Game is 12 years. For children between the ages of 12 and 18, at least one adult must be present for each child.
Article 4: Participation in the Games
4.1 The Player acknowledges and agrees that playing a Game is entirely at their own risk.
4.2 The Player is prohibited from playing a Game while under the influence of alcohol, drugs, or medication that affects awareness.
4.3 During the Game, the Player must always adhere to the applicable traffic rules and safety regulations at the location and time of the Game.
4.4 The Player acknowledges that part of a Game may involve traveling to a certain location by car, bike, foot, or other means. The Player will be aware of the risks involved and focus on the road while driving, cycling, or walking, avoiding dangerous maneuvers.
4.5 The Player will pay attention to their surroundings during the Game and avoid unnecessary risks concerning people and property in that environment.
4.6 The Player is not allowed to use brute force or force things during the Game.
Article 5: Liability
5.1 The Player is responsible for acting with caution, following the game rules, and complying with these general terms and conditions. If these are not followed, Breakout Bandits is not liable, and the Player is responsible for any resulting damages.
5.2 Breakout Bandits is not liable for events beyond its control and thus cannot be attributed to the actions and/or omissions of Breakout Bandits.
5.3 Breakout Bandits is not liable for damage of any kind resulting from incorrect and/or incomplete information or data provided by the Player.
5.4 Breakout Bandits is also not liable for the loss, damage, and/or theft of the Player’s personal belongings during the Game.
5.5 Notwithstanding the provisions of the preceding paragraphs, any liability of Breakout Bandits is limited to the amount paid out in the relevant case by Breakout Bandits’ liability insurance.
Article 6: Personal Data
6.1 Breakout Bandits processes the personal data of Players in accordance with applicable privacy laws and regulations. The way in which Breakout Bandits processes Players’ personal data is described in the Breakout Bandits privacy policy, which also outlines the Players’ rights regarding their personal data.
Article 7: Applicable Law and Disputes
7.1 These general terms and conditions are governed by Dutch law.
7.2 In the event of disputes, the Player, Breakout Bandits, and, if applicable, the Client will consult with each other and attempt to reach an amicable settlement. If this proves impossible, all disputes will be submitted to the competent court of the Rotterdam District Court.
